March Morning Show – Legal Pitfalls in Marketing our Construction, Engineering and Architectural Firms

In today’s age of chasing projects, we design and construction professionals are tasked with marketing our company’s services. We assist in preparing RFPs and other early project procurement activities. We many times respond to client questions about our services and then think “can I really say that”?

March’s Morning Show Program is aimed at providing insight and guidance on the legal implications of our marketing activities so that we avoid pitfalls that can lead to costly outcomes to our employers. The program will address the following issues:

  • RFPs, quotes and “word of mouth” contracts – anatomy of contract formation;
  • The written contract vs. the handshake;
  • The dangers of underestimating costs and not clarifying bids;
  • Scope of work issues during the design, bid and construction phases;
  • The dangers of misrepresentations in design documents;
  • Intellectual property ownership, rights and uses;
  • Confidentiality and non-disclosure agreements and damages; and
  • Avoiding liability for commercial disparagement.

Jeffrey K. Sassic, Esq. – Blumling & Gusky, LLP

Jeffrey Sassic is a member of Blumling & Gusky, LLP’s Construction & Surety Practice Group. Mr. Sassic is a litigator who concentrates his practice on construction, surety, commercial, and business law matters, and has represented and advised owners, architects, engineers, and contractors on various legal issues concerning construction projects.

Mr. Sassic has successfully prosecuted and defended construction claims involving a variety of construction projects, including the following: asbestos abatement, bridges, buildings, concrete, demolition, environmental remediation, geotechnical issues, HVAC, oil and gas drilling, oil and gas pipelines, private projects, public projects, retaining walls, roadways, schools, structural issues, subsurface issues, and wastewater/sewage treatment plants.

Mr. Sassic has several years’ experience working as an engineer for companies in the power industry and the petrochemical industry before becoming an attorney.

Mr. Sassic earned his Bachelor of Science in Industrial Engineering from the University of Cincinnati and his Juris Doctor from the University of Pittsburgh School of Law.

Based upon his qualifications and experience, Mr. Sassic is very familiar with our industry and understands the challenges we face in responding to the demands of our profession.
